Key Aspects of the General Terms and Conditions

Vehicle model: The rental is not necessarily linked to a specific vehicle (brand, model, colour, equipment, etc.) but to a group of vehicles with similar characteristics.
Documentation: The client must present: 1) The booking voucher or booking confirmation number; 2) A Passport or ID card and driving licence in the name of the reservation holder and additional drivers; and 3) A valid credit or debit card in the name of the reservation holder or additional driver.
Minimum age and young driver policy: The minimum age for the driver of the vehicle must be twenty-one (21) years. For certain vehicle groups, the minimum age required may be higher. During the booking process, the driver’s age must be specified to display the available groups. If a client does not meet the minimum age requirement for the reserved vehicle group, TopCar will try to provide a vehicle with a lower age restriction. Drivers aged between 21 and 25 are subject to an additional charge in accordance with the Applicable Rates.
Driving licence: The driver of the Vehicle must have a valid driving licence that is also valid in the Spanish territory and held for at least three (3) years.
Payment methods: Payment must be made using a credit or debit card. It is essential that the following details are clearly legible: (i) the cardholder's full name; (ii) the card number; and (iii) the expiry date. For certain vehicle groups, a credit card may be required. Prepaid, rechargeable, or virtual cards, as well as payments made via any type of electronic device, may not be accepted. Debit cards that present administrative or processing difficulties for refunding the deposit, may also be declined.
Fuel Policy: The client must return the vehicle with the same fuel level as when it was collected.
Out-of-hours vehicle collection: Any reservation starting outside the standard office opening hours will incur an additional fee of €30 for the "Nocturnal" (after-hours) service. This service is available until 01:00 AM.
Transfers between islands: Clients may request an authorisation from TopCar to transfer vehicles between the islands of Fuerteventura and Lanzarote. If authorised, TopCar reserves the right to charge an additional fee and/or deposit. In any case, the Vehicle must be returned by the Client to the island where it was originally rented.
Extension of Rental Agreement: If the Client wishes to extend the rental period, they must notify TopCar in person or by telephone at least twenty-four (24) hours prior to the end of the agreed rental period. TopCar reserves the right to accept or decline such extension of the rental period. The rate applied will be the daily rate in force on the TopCar website at the time of the request. The initial contract rate will not be extended.
Basic Protection: The base rental rate includes the following protections and requires the deposit of an excess:
a) Compulsory third-party liability insurance (TPL); b) Partial collision damage waiver (CDW), which reduces the renter’s liability to the deposit amount for damage to the bodywork of the vehicle; c) Theft protection (TP), which reduces the renter’s liability to the deposit amount in the event of the vehicle being stolen through forced entry.
The excess limitation does not apply in cases of negligence or breach of the general terms and conditions, or if the damage involves elements not covered.
Excess, deposit, or security deposit: To guarantee compliance with all obligations undertaken by the client, TopCar may require an excess. The terms "excess," "deposit," or "security deposit" are used interchangeably. The amount will be determined at the time of rental and will depend on the category of the rented vehicle and the protection coverage chosen. With the Basic Protection, the client is always required to deposit an excess, which may range from €700 to €3,000. To waive the deposit, the optional extended coverage “Super Cover” (SCDW) must be purchased, and payment must be made with a credit card. If the SCDW is purchased and payment is made with a debit card, a €200 deposit will still be required.
Extended Coverage - Super Cover (SCDW): Super Cover (SCDW) is an extended and optional cover that provides protection for: a) Wheels, rims, and punctures; b) Mirrors, rear-view mirrors, glass, and windscreens; c) Lights (headlights, tail lights, and indicators); d) Roadside assistance and towing; e) Aesthetic damage to the bodywork.
Purchasing the Super Cover (SCDW) will, in most cases, exempt the client from leaving a deposit. Below are the exceptions where a deposit is required even if Super Cover is purchased: a) Payment made with a debit card (Deposit amount = €200) and and b) Booking of certain luxury vehicle categories
The Super Cover (SCDW) applies only to the covered items and is void in cases of negligence or breach of the general terms and conditions.
Excluded from any protections and excess: Below are examples of common exclusions. However, the full list of exclusions and client obligations can be found in the general terms and conditions.
- Items not covered: a) Roof, chassis, and underbody of the vehicle.; b) Vehicle keys; c) Interior of the vehicle; and d) Internal components and systems, including but not limited to the transmission system, clutch, gearbox, engine, and steering system, among others.
- Damage caused by driving in areas unsuitable for vehicles, restricted areas, unpaved roads, or paved roads with significant defects that could damage the Vehicle.
- Damage and/or breakage caused by refuelling the Vehicle with a fuel other than the one specified for the Vehicle.
- Damage caused by non-compliance with traffic regulations.
- Accidents where the driver was fatigued, unwell, or under the influence of alcohol, medication, or drugs, as well as reckless driving.
- Damage resulting from using the vehicle when at risk, particularly if dashboard warning lights are illuminated.
- Damage caused by negligence, breach of the general terms and conditions, or improper use of the vehicle.
- Accidents occurring outside the island where the vehicle was originally rented, when such transfer has not been expressly authorised by TopCar.
- Accidents where the driver was not an authorised driver or did not hold a valid driving licence.
Replacement vehicle: TopCar will not be obliged to provide a replacement vehicle in the event of damage or breakdown of the vehicle rented initially. However, in the event that a replacement vehicle is provided, TopCar may require the Client to provide a second security deposit to cover the risks arising from the use of the replacement vehicle, independent of the excess and the protection cover of the vehicle rented initially.
Early return policy: If the rented vehicle is returned earlier than the agreed return date, TopCar will not issue a refund for unused days or services.
Refund of the Excess: The excess amount will be refunded to the client, provided the vehicle is returned on time, in the same condition as it was delivered, with the same fuel level, and the client has fulfilled all obligations under the general terms and conditions. TopCar will charge and refund the excess exclusively in Euros (€). TopCar is not responsible for any discrepancies in the amount received by the client due to currency exchange rate fluctuations or banking administrative fees.
Important note: In the event of any discrepancies or disputes arising from the interpretation of these terms and conditions, only the Spanish version shall be legally binding and prevail.
